Terms of Service.

By using deishmedia.com, downloading a trial, or purchasing a licence from Deish Media LLC (“Deish Media,” “we,” “us”), you agree to these Terms of Service. If you don't agree, don't use the site or the software.

These terms cover every Deish.Audio software product: Prisma Suite, Base6ix, Ryza, Fiya Eye, Smack, Palma and Cymba, and any product later sold under the Deish.Audio line, unless a specific product page states otherwise.

Some products are sold together. Strike is one licence for Smack, Palma and Cymba, which are sold only as Strike. Everything is one licence for all seven products. A bundle licence covers each product in it on exactly the terms in Section 3.

When you buy a Deish.Audio product, you're buying a licence to use the software, not the software itself and not any ownership stake in its code. Deish Media retains all copyright and ownership of the software. Subject to your compliance with these terms, we grant you a:

• Non-exclusive, non-transferable, perpetual (lifetime) licence to install and run the purchased product
• on up to three (3) machines that you own or control, activated with your purchase email and licence serial
• for your own personal or professional use in producing, mixing, or performing audio.

One purchase of a given product's licence covers that product and, where the product page says so (for example, Prisma Suite's five analyzers), every variant built from the same codebase, across all three activation slots. It does not extend to any other Deish.Audio product, except that a bundle licence covers every product in that bundle.

Reached your three-device limit? Email us at deishmedia@gmail.com and we'll free up a slot, for example if you've replaced or retired a machine. The limit exists to prevent licence sharing. It should not block you when your hardware changes.

Moving to a new computer? Deactivate the licence inside the plug-in on the old computer (the licence panel has a Deactivate this device button). That frees its slot, and you can activate on the new one straight away.

Every Deish.Audio product offers a free 30-day trial. The trial is the complete, full-feature product. Nothing is disabled or watermarked, and no account is required to start it. Your trial period begins on first run. When it ends without a purchased licence, the product's analysis or processing features stop until you activate a licence; nothing is deleted, and any project or session data you created remains intact.

Prices are shown on each product's page and charged as a one-time payment. There is no subscription or recurring charge. What you buy is a digital licence: your purchase confirmation and licence serial are sent by email, to the address you give at checkout.

Purchases are sold and processed by Link, a Stripe service, which is the merchant of record. Link calculates and collects any sales tax, VAT or GST, sends your receipt, and handles payment questions. Your card statement shows “LINK.COM*” followed by our name.

The price shown at checkout is the price you pay. Prices may change for future purchases. A change never affects a licence already bought: the rights described in Section 3 continue in full, including every future version of that product, at no further cost.

Every product has a full-featured 30-day trial so you can be sure before you buy. For that reason, all sales are final, with these exceptions:

• We refund duplicate purchases and purchases you did not authorise.
• If a product does not work as described on your system and we cannot fix it, we will refund it. Please email deishmedia@gmail.com first, so we can try.
• Link, as the merchant of record, may also review refund requests within 60 days under its own policy.

Your legal rights are not affected. If you live in the European Union or the United Kingdom, you have a 14-day right to withdraw from an online purchase. Our products are digital content delivered immediately: by downloading or activating a licence, you consent to immediate delivery and acknowledge that you lose that right once delivery starts. If you live in Australia, our products come with guarantees that cannot be excluded under the Australian Consumer Law, including a remedy for a major failure. Nothing in these terms limits rights like these.

If you dispute a charge with your bank, Link handles the dispute. Please contact us first at deishmedia@gmail.com, because we can usually fix the problem faster. If a payment is reversed, the licence it paid for stops being valid.

You agree not to:

• Reverse-engineer, decompile, or disassemble the software, except to the extent applicable law expressly permits despite this restriction
• Redistribute, resell, sublicense, rent, or share your licence serial with anyone outside the three-device limit described in Section 3
• Attempt to circumvent, disable, or tamper with the trial timer or the licence-activation system
• Use the software in any way that violates applicable law

We may suspend or revoke a licence for a violation of this section, including a shared or leaked serial, without a refund.

The software and this website are provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the software will be compatible with every DAW, operating system version, or hardware configuration, or that it will be uninterrupted or error-free.

To the maximum extent permitted by applicable law, Deish Media's total liability to you for any claim arising from these terms or your use of the software or site is limited to the amount you actually paid for the product giving rise to the claim. Deish Media is not liable for any indirect, incidental, consequential, or special damages (including, without limitation, lost audio project files, lost studio time, or lost profits), even if we've been advised of the possibility of such damages.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some or all of this limitation may not apply to you.

We may suspend or terminate your licence if you materially breach these terms (for example, sharing a serial, a chargeback under Section 7, or circumventing activation). Sections 9 and 10 survive any termination of your licence.

You agree not to scrape, disrupt, or attempt unauthorized access to deishmedia.com or its underlying systems. Content on this site (text, design, product imagery) is owned by Deish Media unless otherwise noted, and this site links to some third-party sites and services (for example, Stripe checkout and Etsy) that we don't control and aren't responsible for.

VST is a registered trademark of Steinberg Media Technologies GmbH. Audio Units is a trademark of Apple Inc. Ableton, FL Studio, Logic Pro, Pro Tools, Cubase, Studio One, Bitwig and REAPER are trademarks of their owners. We use these names only to describe compatibility. Deish Media is not affiliated with or endorsed by these companies. The licences of third-party software in our products are listed at Third-party notices.

These terms are governed by the laws of the state in which Deish Media LLC is organized, without regard to conflict-of-laws principles.

We may update these terms as the product or the business changes. We'll update the “Last updated” date above when we do; continued use of the software or site after a change means you accept the updated terms.
